Terms of Service

1. Acceptance of Terms

By inviting WackyBot ("Bot", "Service") to your Discord server or using its commands and features, you ("User", "you") agree to be bound by these Terms of Service ("Terms") and the WackyBot Privacy Policy. You also agree to abide by the Discord Terms of Service and Community Guidelines. If you do not agree to these terms, do not use the Bot.

2. Use of the Service

WackyBot is provided "as is" for enhancing Discord servers with moderation, games, economy, and utility features. You are granted a non-exclusive, non-transferable, revocable license to use the Bot in accordance with these Terms.

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you, and we will not be liable to you or to any third party should we exercise such rights.

3. Prohibited Conduct

You agree not to misuse the Service or help anyone else do so. Specifically, you agree not to engage in any of the following prohibited activities:

• Attempting to exploit vulnerabilities, bugs, or unintended features of the Bot.
• Using the Bot for any illegal or unauthorized purpose, including violating any applicable laws or regulations.
• Spamming commands or otherwise generating excessive load on the Bot's infrastructure with malicious intent.
• Automating interactions with the Bot through unofficial means (e.g., self-bots).
• Using the Bot to harass, abuse, defame, or harm others.
• Distributing viruses, malware, or any other malicious code through the Bot's features (e.g., via custom embeds).
• Attempting to circumvent any restrictions or rate limits imposed by the Bot or Discord.
• Impersonating the Bot or its developers.
• Using the Bot in a way that violates Discord's Terms of Service or Community Guidelines.

4. Consequences of Violation

Violation of these Terms or engagement in prohibited conduct may result in temporary or permanent suspension of your access to the Bot's services, at our sole discretion. This may include blacklisting your user ID or the server ID from interacting with the Bot. For severe or malicious violations, there may be no appeal process.

5. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WACKYBOT OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Effective Date" at the top of this page and potentially through Discord announcements. Your continued use of the Bot after such changes constitutes your acceptance of the new Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Bot's primary developer resides, without regard to its conflict of law provisions.
